High Court in Nairobi has ordered the retrial of rugby players Alex Olaba and Frank Wanyama who are serving 15 years in prison, reports Citizen TV.
The case will now be heard afresh at a lower court with the High Court directing that the two be taken to Kilimani Police station for the preparation of plea taking before July 7.
Wanyama and Olaba were sentenced to 15 years each back in August 2019 after being found guilty of gang-raping a woman in 2018. Citizen TV reports that in the fresh ruling, the court noted that the existing records do not show whether one of the witnesses was sworn or not.
On Friday, August 16, 2019, Chief Magistrate Martha Mutuku sentenced the duo one week after finding them guilty -while allowing 14 days to lodge an appeal. Wanyama and Olaba were accused of raping a woman at Highrise Estate, Seefar Towers, Nairobi in February 2018 on her birthday.
The two, who played for Kenya Cup side Kenya Harlequin, have represented the Kenya 7s rugby team at the World Sevens Series.
